GENERAL TERMS AND CONDITIONS OF BUSINESS

1. Scope of Application

These General Terms and Conditions (hereinafter "GTC") of Gutraum 8 GmbH (hereinafter "Seller") apply to all contracts concluded by a consumer or entrepreneur (hereinafter "Customer") with the Seller regarding goods and/or services displayed in the online shop.

Deviating conditions of the Customer are not recognized unless the Seller expressly agrees to their validity.

A consumer within the meaning of these GTC is any natural person who concludes a legal transaction for purposes that are predominantly neither commercial nor their independent professional activity.

An entrepreneur within the meaning of these GTC is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of their commercial or independent professional activity.

2. Formation of Contract

The products displayed in the online shop do not constitute a legally binding offer, but an invitation to place an order.

The Customer can submit a binding offer to conclude a purchase contract via the order form integrated into the online shop. After selecting the goods and going through the electronic ordering process, the Customer submits a legally binding contractual offer by clicking the final order button.

The Seller can accept the Customer's offer within five days:

  • by sending an order confirmation in text form (e.g., email)

  • by delivering the ordered goods

  • or by requesting payment

The contract is concluded at the time when one of the aforementioned alternatives occurs first.

The contract text is stored. After sending the order, the Customer receives an order confirmation and these GTC by email.

3. Retention of Title

The delivered goods remain the property of the Seller until full payment has been received.

4. Right of Withdrawal

Consumers have a statutory right of withdrawal.

Further information on the right of withdrawal can be found in the Seller's separate withdrawal policy.

5. Prices and Payment Terms

All prices in the online shop are final prices and include the statutory VAT.

Additional shipping costs incurred are shown separately in the respective offer and during the ordering process.

The Customer has the payment methods displayed in the online shop available. The Seller reserves the right to exclude individual payment methods.

If the payment method "prepayment" is selected, the invoice amount must be transferred within 10 days of receiving the order confirmation.

6. Delivery Conditions and Shipping

Delivery will be made to the delivery address specified by the Customer.

The currently available delivery countries, delivery times, and shipping costs are displayed in the online shop, on the "Shipping & Delivery" page, and during the ordering process.

Unless a different period is specified in the respective offer, delivery will be made after receipt of payment or after conclusion of the contract.

Shipping within Germany

  • Shipping costs: €5.90

  • Free shipping for orders over €49.90

International Deliveries

We deliver to numerous countries within the European Union as well as to other selected countries.

The currently available delivery countries and shipping costs are displayed during the ordering process.

Individual worldwide deliveries are possible upon request.

7. Warranty

The statutory warranty rights apply.

8. Liability for Content and Links

As a service provider, we are responsible for our own content on these pages in accordance with general laws as per § 7 Abs.1 TMG.

Our offering contains links to external third-party websites, the content of which we have no influence over. We assume no liability for this content.

Upon becoming aware of any legal infringements, such content or links will be removed immediately.

9. Applicable Law

All legal relationships are governed by the law of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods.

For consumers, this choice of law only applies insofar as it does not restrict mandatory legal provisions of the state in which the consumer has their habitual residence.
